SHERMAN, N.Y. — A 29-year-old man was shot in Sherman early Sunday morning and later died at a hospital.
Deputies from the Chautaqua County Sheriff's Office responded to a report of a shooting incident in the area of 114 W. Main St. in the village of Sherman, New York, at about 1:36 a.m. on Sunday.
Upon arrival, deputies found Justin M. Gibbons, 29, of Mayville, New York, had been shot multiple times. Gibbons was transported to Westfield Memorial Hospital by the Sherman Volunteer Fire Department ambulance and pronounced dead shortly thereafter.
Through the course of an investigation, authorities determined Gibbons had been involved in an altercation in an alleyway near the back of a bar called Cooler Cafe. Police said the altercation involved Gibbons and Julio E. Montanez, 25, of Jamestown, New York.
Authorities say Montanez produced a handgun during the course of the altercation and fired multiple rounds at Gibbons while he was attempting to flee the area in a vehicle.
Gibbons was struck multiple times by rounds fired by Montanez, resulting in his death.
Montanez has been charged with one count of manslaughter in the first degree and he is currently in Chautauqua County Jail pending his arraignment on the charge.
